All wine/spirits is sold "AS-IS," without any representations or warranties, express or implied, including, but not limited to, as to merchantability, fitness for a particular purpose or the correctness of the catalog or other description of physical condition. 3. All risks of loss and damage to wine passes to you upon shipment of the wine / spirits purchased and we are not responsible for any acts or omissions in connection with the packing or shipping of the wines / spirits or of carriers, whether or not recommended or selected by us. All wines and or spirits purchased are nevertheless insured for shipping purposes. 4. You shall pay any applicable state and local taxes, and any applicable compensating use tax of another state which we may be required by law to collect at the time of the payment of the purchase price. 5.
